Kent Summer Assizes, Maidstone Thursday August 16:
John Featherstone, William Featherstone and Mary Featherstone (brothers and sister) were indicted for burglariously breaking and entering the house of Mr John Martin at Brenchley in the night of the 27th March last and stealing therein 100-lbs Pork and 10-lbs flour, his property.
The appearance of the prisoners, particularly the female, was much above their situation and excited universal sympathy.
It appeared that the property in question was left secure on the evening of the day charged and was missed at six the next morning, when the pantry window was found forced open, the meat gone, and a piece of a cotton gown hanging to the fractures of the casement. This piece was afterwards tried with a gown (found in the house of the father of the prisoners where they all lodged), belonging to the prisoner Mary and exactly fitted a fracture in it. -
None of the property was found on any of the prisoners, but they were seen at home the next day eating pork pie.
A written confession by the unhappy girl was put in, which put her guilt beyond all doubt, but did not have the effect of involving her brothers.
Under these circumstances, the Jury under the learned Judge's direction found the prisoner Mary Featherstone guilty, and acquitted the other two.
Sentence of death was passed upon her.

Thomas Featherstone died on 29 October 1854 at Union Street, Maidstone, Kent, EnglandG, aged aged 92.4 He was buried on 4 November 1854 at Tudeley cum Capel, Kent, EnglandG, (burial entry at Tudeley states abode Tonbridge.)
     Y. Kent Database; Y. He On the Christening records for Brenchley his mother's name is recorded as Jane. This must surely be a mistake??? On the 1851 census, as with the earlier christenings of his children, Thomas Featherstone's employment is given simply as 'agricultural labourer', which does not suggest that he was a man of property or means. However, according to a microfilm of the Overseers of the Poor vestry records for Seal 1830-32 a Poor-law assessment for Thomas Featherstone of Underriver values him at £60, giving him a bill of £3 to be paid into the Parish coffers for the support of unemployed farm labourers during the winters of 1830-1832. The records for other years of this assessment do not appear to have survived. There was also a rent assessment for 1832, with the same valuation and billing him for £10 for rent for that year. At that sum, he was the second richest man in the village after the village Squire, and of greater value than the Countess of Amesbury, who is assessed at only £3910/6!! It would also appear that Thomas Featherstone Jnr. became a officer of the Overseers on March 25th 1833. His signature appears in the 1832 records, also. There are also records of Thomas Snr taking on labourers to relieve the parish
of their maintenance during the winter of 1832, as follows: December . Employed George Humphrey for 2 weeks 11 days at 2d per day. December 21 Employed Wm. Price at 1/6d January 11 Employed Charles Tye 12 days 1/6d And again later in the records: December 23 William Tye at 1/-d(?) per day Returned employment refused.
Is certain he employs more than his complement of men. Jany 6 Geo. Worth at 1/8d(?) per day. Paid the above. Feby 2 James field at what he is worth. Uncertain what he has been paid. Paid £13. And again Wm Tye from 13 December at 1/-d per day or by the quarter. Returning employment refused. Wants a bricklayer. James Marchant from Jany 3 at 1/8d per day. Paid 6/-d It is possible he had a small-holding, rather than a proper farm, and possibly some cottages, hence the request for a bricklayer. Who knows.
We need to see some sort of map of the area which shows landowners, perhaps, if such a thing exists? Interestingly George Featherstone (probably the nephew of Thomas and cousin of Mary) was also in receipt of relief of £1 from the Overseers of the Poor at one stage. Christine Normington

Eric and I have had time to think about this more overnight, okay? We will stick our necks out here and say we believe this is the son of Thomas Featherstone, born Tudeley. This Thomas is the one we have always had trouble with trying to find the christening for, if you remember. We thought he was younger, but now I'm wondering if perhaps he was born outside of Kent - possibly even prior to his parents marriage or soon after (Thomas married Susannah Fordham in St. Marylebone).

Some of Thomas and Susanna's (1764) children were known to have been born in Brenchley, but christened in Tudeley, while the rest were done at Brasted. Arthur's will, if I remember right, did appear to dictate for a while where Thomas lived, too. I think the property was scattered about the county and I still adhere to the idea that the reason there was no will when Thomas Snr. died is because Thomas Jnr. had already been given the property BEFORE his father died. The 1841 census does seem to support this theory.

Put it this way, if you'd been paying all that tax for years, would you as an old man want to carry that on? Or would you hand the property over to your son and become an 'ag. lab.'? I think I would do the latter, because technically, they would both pay exorbitant taxes otherwise.

The other alternative is that the 2 Thomases may have rented the farm, so not owned the land, but merely 'farmed' it.

We did go into all this quite thoroughly a couple of years back, but we could never find a second Thomas of similar age as mine - apart from the one in Seal, who married Hester Welland and they all died very early on. Every blessing, Christine 1 November 2002

     Y. Kent Database; Y. He Sorry scrap that information on that other Thomas Featherstone, it's wrong! I have just checked the fiche and Thomas was 29 at death. I also had father and son the wrong way round. This is now correct. The age at death in the father's case is recorded as 29, hence the year of birth about 1753. I don't know who this Thomas was and have not connected him to my family yet, but he was living in Seal at least for a while. Possibly he came from the neighbouring village of Ightham where he married. Christine Normington.
